MEMBERSHIP AGREEMENT

Customers who use and shop on this e-commerce site are assumed to have accepted the following terms:
The web pages on our site and all associated pages belong to and are operated by Rabia Akdemir company at novaatelier.co. By using all services offered on the site ("User"), you agree that you are subject to the following conditions, by utilizing and continuing to use the services on the site; that you have the legal right, authority, and legal capacity to sign the agreement according to applicable laws, that you are over 18 years of age, that you have read, understood, and agreed to be bound by the terms written in this agreement.
This agreement is indefinite, imposes rights and obligations related to the subject site on the parties, and by accepting/approving this agreement online or in writing, the parties declare and undertake to fully, accurately, and timely fulfill these rights and obligations as required in this agreement.
1. RESPONSIBILITIES
The company always reserves the right to change prices and offered products and services.
The company agrees and undertakes that the member will benefit from the contracted services except for technical failures.
The user agrees not to perform reverse engineering or any other attempts to find or obtain the source code of the site; otherwise, the user shall be responsible for any damages caused to third parties and subject to legal and criminal action.
The user accepts that they alone will be responsible for damages caused by providing incomplete or incorrect information during site membership and that if incorrect information is given or this agreement is violated by the user, the company may unilaterally terminate the membership without any notification or warning.
For the improvement and development of the website and/or within the scope of legal regulations, certain information such as the Internet service provider name used to access the site, Internet Protocol (IP) address, access date and time, the pages accessed during the session, and the web address allowing direct connection to the site may be collected. The user accepts the collection of this information.
The user agrees not to produce or share content within site activities, any site section, or communications that are contrary to general morality and etiquette, unlawful, damaging to third-party rights, misleading, offensive, obscene, pornographic, infringing personal rights, violating copyright, or promoting illegal activities. Otherwise, the user is fully responsible for the resulting damages, and the 'Site' authorities reserve the right to suspend or terminate such accounts and initiate legal proceedings. Accordingly, if judicial authorities request information related to the event or user accounts, the site reserves the right to share this information with authorities.
The relationships between site members themselves or with third parties are their own responsibility.
2. INTELLECTUAL PROPERTY RIGHTS
2.1. All intellectual property rights, registered or unregistered, including titles, business names, trademarks, patents, logos, designs, information, and methods found on this Site belong to the site operator and owner company or the designated party and are protected by national and international law. Visiting this Site or benefiting from services on this Site does not grant any rights concerning these intellectual property rights.
2.2. Information on the Site cannot be copied, published, duplicated, presented, or transferred in any way. Neither the whole nor any part of the Site may be used without permission on another website. In such a violation, the user shall be liable for compensation demanded by the company for damages suffered by third parties, court costs, attorney fees, and all other obligations, including but not limited to these.
3. CONFIDENTIAL INFORMATION
3.1. The company will not disclose personal information provided by users via the site to third parties. Such personal information includes name, surname, address, phone number, mobile phone, email address, and any other information identifying the User, collectively referred to as "Confidential Information."
3.2. The user accepts and declares that for marketing activities such as promotion, advertisement, campaign, announcement, etc., the company owning the site may share the user's contact, portfolio status, and demographic information with its affiliates or group companies and that the user consents to receive electronic communication in this regard directed to themselves or affiliates. This personal information may be used within the company to determine customer profiles, offer promotions and campaigns suitable to customer profiles, and perform statistical studies.
3.3. The user has the right to revoke the consent given under this agreement without any reason. The company will process the revocation immediately and cease electronic communication to the user within 3 (three) business days.
3.4. Confidential Information may only be disclosed to official authorities if demanded duly and in accordance with compulsory provisions of applicable laws, where disclosure to official authorities is mandatory.
4. NO WARRANTY:
THIS ARTICLE OF THE AGREEMENT SHALL BE VALID TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SERVICES PROVIDED BY THE COMPANY ARE OFFERED "AS IS" AND "AS AVAILABLE" AND DO NOT PROVIDE ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, WHETHER STATUTORY OR OTHERWISE, CONCERNING THE SERVICES OR APPLICATION (INCLUDING ALL INFORMATION THEREIN).
5. REGISTRATION AND SECURITY
The user must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be considered violated, and the user’s account may be closed without notification.
The user is responsible for password and account security on both the site and third-party sites. The company is not liable for any data loss, security breaches, or damage to hardware and devices arising from negligence.
6. FORCE MAJEURE
Neither party shall be responsible for failure to perform contractual obligations due to causes beyond their control, including natural disasters, fire, explosions, civil wars, wars, uprisings, popular movements, mobilization declarations, strikes, lockouts, epidemics, infrastructure and internet failures, power outages (hereinafter collectively referred to as "Force Majeure"). During this period, the parties' rights and obligations arising from this Agreement shall be suspended.
7. ENTIRE AGREEMENT AND ENFORCEABILITY
If any provision of this agreement becomes partially or wholly invalid, the remainder of the agreement shall continue to be valid.
8. CHANGES TO THE AGREEMENT
The company may partially or fully change the services offered on the site and the terms of this agreement at any time. Changes will be effective from the date they are published on the site. It is the user’s responsibility to follow the changes. By continuing to benefit from the offered services, the user is deemed to have accepted these changes.
9. NOTICES
All notices related to this Agreement shall be sent by the company to the known email address and the user’s email address provided in the membership form. The user accepts that the address given during membership is valid for notices and that any change must be reported in writing to the other party within 5 days; otherwise, notices sent to this address shall be deemed valid.
10. EVIDENCE AGREEMENT
In disputes arising from transactions related to this agreement, party bookkeeping, records, documents, computer records, and fax records shall be accepted as evidence under the Turkish Code of Civil Procedure No. 6100, and the user accepts not to object to these records.
11. DISPUTE RESOLUTION
Courts and Enforcement Offices of Ankara (Central) Judicial District shall have jurisdiction over all disputes arising from the implementation or interpretation of this Agreement.
